Records for financial redress
Care experienced people have many reasons for accessing their care records including applying to the Scottish Government’s Financial Redress Scheme. There are several options available to you depending on which level you wish to apply for.
Fixed Rate Payment
To apply for the fixed rate payment of £10,000 through Redress Scotland, you must show that you were resident in a relevant care setting when you suffered abuse. To help your application, we can provide you with an extract of your care record and a letter confirming your time in care. This can include the name of the care settings you were living in and the dates you were there. To get this information, you need to submit a Subject Access Request, and outline to us that this is all you are looking for at this stage. If you wish to access your full care file at a later date, you can, as it is your right to do so.
Individually Assessed Payment
To apply for an individually assessed payment, you will need to supply supporting documentation in the form of your care records. You will need to submit a Subject Access Request and ask us to provide you with your care file, or specific time periods from your care file. When you receive your care records, some information that does not relate you to will be blacked out (redacted). This is because we have to redact third party information to comply with the relevant legislation. You should receive your information within one month of us receiving your request. If your care records are large and contain a lot of sensitive data about other people, we can extend that deadline to three months. We will always contact you to let you know if we have to extend the deadline and explain why we have to do this.
Application by Next of Kin
Where a survivor died on or after 1 December 2004, partners or children, may be able to apply for a next of kin redress payment of £10,000. You will need to submit supporting documentation to showing the establishments your relative was resident in and the dates they were there. If we hold their records, we can provide you with timeline of their time in care and an extract from their file using the Subject Access Request process.
