Breach of activities
Without planning permission, the alteration and change of use of the lock-up garage to a Class 4 Business Use and/or Residential Studio. The unauthorised alteration relates to the removal of a roller shutter at the front of the building thereby revealing a glazed frontage in keeping with an office/residential character.
Requirements
It appears to the Council that the above breach of planning control has occurred within the last four years in respect of the alteration and in the last ten years in respect of the use. Planning permission was granted for the erection of a garage in 2012. Subsequent planning applications, reviews and appeals have been unsuccessful in allowing a change of use from the single garage to a form residential studio/office accommodation. The change of use of a garage to a Business Use (Class 4) and/or a Residential Studio (Class 9) as set out in the Town and Country Planning (Use Classes) (Scotland) Order 1997 constitutes a material change of use which requires planning permission. Attempts at gaining planning permission have been unsuccessful. The alteration to the frontage of the building constitutes development. The building is located in the New Town Conservation Area and therefore the alteration does not benefit from having permitted development rights under the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (as amended). Planning permission is therefore required. The alteration is detrimental to the character and appearance of the conservation area and unlikely to gain planning permission.
