Breach of activities
Without planning permission, the change of use of the residential lock-up garage to a general industrial (Class five) use.
Requirements
It appears to the Council that the above breach of planning control has occurred within the last ten years in respect of the use. The change of use of a residential garage to a general industrial (Class five) use as set out in the Town and Country Planning (Use Classes) (Scotland) Order 1997, as amended, constitutes a material change of use which requires planning permission. The unauthorised use has an adverse effect on neighbouring residential amenity by virtue of noise and disturbance. The change of use is contrary to the adopted Local Development Plan (LDP) Policy Hou 7 Inappropriate uses in Residential Areas. Developments including change of use, which would have a materially detrimental effect on the living conditions of nearby residents, will not be permitted. The change of use to a general industrial (Class five) use has a detrimental impact on neighbouring residential amenity.
